Ik moet voor legal english een casus uitwerken over Sex tourisme in Zuidafrika, en dan met name de vraag of iemand uit Nederland aan zuidafrika kan worden uitgeleverd voor misdaden die in Zuidafrika zijn begaan?
Maar ik kom er eigenlijk niet uit, weet iemand hier antwoord op?
Ik zal de casus voor de duidelijkheid even plaatsen:
Case outline:
On the 3th of July 2008 Herman went to visit Capetown for 2 months for a businesstrip. But this trip did not ended that well, because on the 31st of July 2008 Herman was arrested for being guilty on sextourism. The manager of the hotel, were Herman was staying, caught him a few times entering his room with a minor boy.
Herman was released out of prison after 3 days (reason unknown), but probably because of corruption. He returned back to the Netherlands on the 4th of August 2008 and as our client he would like to know if he has to be afraid for a conviction in the Netherlands.
This because the 11-year old Jimmy Kamboyaya has made a report of sexual ensolvement after Herman left to the Netherlands, probably he was afraid of Herman.
Yesterday Herman get a call at his place in the Netherlands of the police in Capetown about the report of Jimmy Kamboyaya.

Ik geloof dat ik het antwoord al gevonden heb:
In extradition cases in the Netherlands next to the so called "Uitleveringswet" (Extradition law) also the extradition treaty with the specific country is important. The criminal case itself will not be dealt with. In short the court has to investigate whether the formalities are in order, whether the criminal act is an offence in both the requesting country as in the Netherlands, whether there is a minimum penalty of one year in prison, can one immediately proof one's innocence or not, are there reasons of humanitarian nature why one should not be extradited, isn't there a breach of the statute of limitations, hasn't one not already been prosecuted (ne bis in idem) and, if extradition will follow, will the requesting country only prosecute one for the fact for which the extradition is requested (speciality). South Africa currently has no extradition agreements with the Netherlands.
Article 2 of Constitution of the Netherlands states that: 3. Extradition may take place only pursuant to a treaty. |

Klopt! Valt onder noemer Internationaal en Europees recht.
